Whose insurance applies after an Uber or Lyft crash?
It depends on what the driver was doing at the moment of the crash: offline (personal insurance only), app on but no ride accepted (limited rideshare coverage kicks in), or ride accepted or passenger in vehicle (the rideshare company's $1 million liability policy typically applies in Florida).
Can I sue Uber or Lyft directly?
Rideshare drivers are treated as independent contractors, which complicates direct claims against the company. However, their insurance coverage is often available even when suing the company itself is difficult.
I was the passenger — am I automatically covered?
If the driver had the app on and accepted your ride, yes — the $1M policy generally covers passenger injuries regardless of which driver was at fault. If another driver caused the crash, you may also have claims against them.
Do I still deal with my own PIP?
Yes. PIP is the first layer in Florida and applies regardless of fault. Passengers without their own policy can usually tap the rideshare driver's PIP.
What should I document after a rideshare crash?
