Who can file a wrongful death claim in Florida?

Under Florida's Wrongful Death Act, the claim is brought by the personal representative of the decedent's estate on behalf of the estate and eligible survivors — typically spouse, children, and sometimes parents.

What damages are available?

Lost support and services, funeral and medical expenses, loss of companionship and guidance (for surviving family members), and the survivors' mental pain and suffering. Specific categories depend on the survivors' relationship to the decedent.

How long do I have to file?

Florida's wrongful death statute of limitations is generally 2 years from the date of death, but there are exceptions — medical malpractice and intentional acts are handled differently. Don't assume you have plenty of time.

Does a criminal case need to happen first?

No. A wrongful death civil claim is independent of any criminal case, uses a lower burden of proof (“preponderance of the evidence”), and can proceed regardless of the criminal outcome.

What if the at-fault party doesn't have enough insurance?
